A NSW jewellery retailer has modified their two price advertising and pricing practices following an investigation by the ACCC.

The retailer failed to respond to a request for information following the receipt of an industry complaint to the JAA Industry Code of Conduct. Based on the information provided by the complainant, the Code Committee considered that there may be a breach of paragraph 14 of the Code, and possibly a breach of Australian Consumer Law. The matter was then referred to the ACCC, who conducted an investigation, with officers attending the store to inspect advertising material, price offers, and to interview staff.

During the investigation the retailer then volunteered to modify their practices.

“Even though the retailer was not a JAA member, and not a participant of the Code, they were invited to co-operate with the Code Committee to determine if there was a breach.” said Colin Pocklington, Chair of the Code Committee.

“We prefer to assist all retailers, whether JAA members or not, to comply with the Code, as this benefits both consumers and the industry as a whole. Referring matters to the ACCC is a last resort.”

The ACCC has been very supportive of the JAA’s endeavours to encourage industry best practice through the implementation and enforcement of the JAA Industry Code of Conduct.
